Terms and Conditions

1. Applicability and Scope

The following General Terms and Conditions (hereinafter referred to as "GTC") apply to all business relationships between Fendo Fashion Group (hereinafter referred to as "Sample AG", "us" or "we") and the customer (hereinafter referred to as "Sample AG", "customer", "buyer" or "you") for products (hereinafter referred to as "products" or "goods") purchased via our Fendo Fashion Group website (hereinafter referred to as "online shop" or "website").

Individual agreements made with the customer take precedence over these General Terms and Conditions. Any conflicting terms and conditions of the customer are not recognized.

Fendo Fashion Group reserves the right to amend these Terms and Conditions at any time. All amendments will become effective upon publication of the new Terms and Conditions on the website. For the purchase of a product, the applicable Terms and Conditions are those in effect as of the date the binding order was placed with us.

Please read these terms and conditions carefully before placing a binding order. By placing a binding order for our products, you agree to the following terms and conditions and our privacy policy, and you confirm that you are legally authorized to enter into binding contracts and are at least 18 years old.

2. Conclusion of a purchase agreement

The presentation of products in the online shop does not constitute a legally binding offer, but merely a non-binding online catalog or an invitation to the customer to order the product in the online shop. Fendo Fashion Group expressly reserves the right to change the products themselves and the content, such as images, assortment, prices, and descriptions of our products, at any time and without prior notice. Illustrations, images, brochures, advertisements, and other information about our products are for informational purposes only and are not binding for Fen-do.ch.

The customer can place a binding order for their selected products via our online shop. The customer can add the selected products to the "shopping cart." This does not yet constitute a binding order. An order only becomes binding when the customer clicks the "Place order" button at the end of the ordering process on the order page. Before submitting the order, the customer has the opportunity to review and change the information at any time, identify any input errors, and correct them if necessary before final, binding submission of the order.

An order confirmation will be sent to the customer immediately and automatically via email. This confirmation email contains your order details and our Terms and Conditions, which you accepted during the ordering process. The confirmation email merely serves to inform you that we have received your order. This automatic order confirmation does not yet constitute a purchase agreement. By submitting your order, you confirm that you have read and unconditionally agree to the Terms and Conditions. We recommend that you print or save the Terms and Conditions on your computer for your records and for the purpose of placing your online order.

After you have placed a binding order, Fendo Fashion Group is free to accept or reject the order at its sole discretion by sending a corresponding notification via email, without incurring any liability to you or any third party. Any payment already made will be refunded to you if the order is cancelled. Reasons for rejecting an order may include, for example, if a product is no longer available, if we cannot obtain authorization for payment from the customer, or if there is reason to believe that the customer has violated these Terms and Conditions, individual contracts, or engaged in fraudulent activities, or has committed other criminal offenses or for another important reason.

A binding purchase agreement is concluded with the customer upon acceptance of the order. This acceptance occurs through the shipment of the ordered products.

Any commercial distribution or resale of our products is strictly prohibited.

3. Availability and performance reservation for unavailable products

All information regarding product availability, shipping, and delivery is preliminary and approximate. It does not constitute a binding or guaranteed shipping or delivery date. Liability for unavailable products or for delays in shipping or delivery is expressly excluded.

Our products are available while stocks last. Should Fendo Fashion Group discover during the processing of your order that the products you ordered are unavailable, we will inform you immediately.

We also reserve the right to limit the number of items a customer can purchase. In this case, we will inform the customer by email.

4. Payment methods

The following payment methods are available:

  • Credit card (Visa, Mastercard, American Express)

  • PayPal

  • TWINT

  • Bank transfer

  • Purchase on account (after credit check)

In case of late payment, we reserve the right to charge reminder fees (from CHF 50) as well as statutory default interest.

4. Prices and shipping costs

Our products and prices correspond to those stated on the website. All prices are in CHF (Swiss Francs), US Dollars, and Euros, and include the statutory value-added tax (VAT) of 7.7%. The total price of your order, including all additional charges and shipping costs, will be displayed at the end of the ordering process. For shipments to countries outside of Switzerland, additional customs duties may apply. These are not included in the price and must be paid by the customer.

By placing a binding order, you declare that you agree to the total price for the ordered products. Once a binding order has been placed, a price adjustment is no longer possible.

Fendo Fashion Group reserves the right to change prices at any time. Product prices are calculated based on the prices offered at the time of the binding order.

5. Payment terms/credit check

Orders are generally due for immediate payment.

The customer has the option to pay using the payment methods displayed on the website or during the ordering process. These may change from time to time and may vary depending on the country. Furthermore, we reserve the right not to offer certain payment methods in individual cases and to refer customers to other payment methods we use (e.g., to mitigate our credit risk, only those corresponding to the customer's creditworthiness). Fendo Fashion Group is expressly authorized by the customer to conduct credit checks at its own discretion and, if necessary, to pass on customer data to third parties for this purpose.

By selecting a payment method, the customer authorizes the payment either by entering their credit card details or login credentials for a payment service provider. The customer authorizes Fendo Fashion Group to accept and collect payments appropriately. In the event of chargebacks, Fendo Fashion Group is entitled to reimbursement of the associated costs and bank processing fees. Furthermore, Fendo Fashion Group is not liable for any fees or other charges that your card issuer or bank may levy in connection with processing your payment for your order.

If you pay by credit card or alternative payment method, we reserve the right to verify the card's validity, check the availability for pickup and address details, and request authorization from the card issuer or payment provider. You also confirm that the credit card is valid and the payment details entered are correct. In case of payment refusal, Fendo Fashion Group reserves the right to cancel the order and discontinue shipment of the products. In this case, we will contact you immediately.

When paying by invoice, the customer receives the invoice with a payment slip upon delivery of the goods or via email. Payment must be made by payment slip within the payment period specified on the invoice. If payment is not received on time, Fendo Fashion Group is entitled to charge its expenses of at least CHF 50 per reminder, as well as any further costs associated with debt collection and statutory default interest. Should it become necessary to initiate debt collection proceedings, we will charge an additional processing fee of at least CHF 200.

6. Delivery conditions

Deliveries are generally made via the Swiss Post delivery service. For deliveries within Switzerland, the buyer must pay the applicable costs in advance. For deliveries within the EU, the following delivery services are used: Swiss Post or couriers such as DHL and TNT. The desired delivery service can be selected during the ordering process. The buyer must pay the applicable costs in advance.

Products ordered from our online shop that are in stock will be shipped within 8 business days of receiving full payment, depending on the destination. You can track your order's current location using the tracking number.

Should the products be marked as out of stock at the time of ordering, Fen-do.ch will endeavor to deliver them as quickly as possible. Fendo Fashion Group strives to adhere to the stated delivery times. However, Fendo Fashion Group is not responsible for delivery delays, regardless of the cause. We will inform you immediately about any delays in delivery.

If the impediment to performance lasts longer than 5 weeks after the original delivery date, the customer is entitled to cancel their order. Further claims, in particular claims for damages, are excluded.

Should delivery of the goods fail due to the customer's fault despite two delivery attempts, Fendo Fashion Group may withdraw from the contract. Any payments already made will be refunded immediately.

7. Retention of title

Fendo Fashion Group retains ownership of the delivered products until full payment has been received.

8. Returns & Exchanges

Customers can exchange unworn, undamaged, and unaltered items within 14 days of delivery. Discounted items are excluded from this return policy. Purchased items can be exchanged directly in the store or returned by mail. Return shipping is available within Switzerland. Return shipping costs must be borne by the customer.

When returning an item, customers can choose between an exchange or a voucher for the value of the returned item. If the customer chooses one of these options, they must indicate this on the corresponding form and send the completed form to Fendo.

Once the returned item has been processed in our warehouse, we will initiate the following steps:

  • The replacement item will be shipped within 3-5 working days after receipt of the returned item.
  • Sending a Fendo voucher for the value of the returned item within 7-10 working days.

Further details

  • Accessories cannot be exchanged or refunded as a matter of principle.
  • Pinned dresses are considered altered and purchased items. These can only be exchanged or refunded with a voucher.
  • Vouchers cannot be returned or refunded.
  • Fendo does not offer a refund of the purchase price in the event of a return.
  • For returns, the actual purchase price will be charged for the exchange or voucher. Used discount codes are not valid and cannot be reused for exchanges.

9. Notice of defects/warranty

Fendo Fashion Group guarantees that the goods conform to the promised characteristics and have no defects that impair their value or suitability for their intended purpose.

Upon receipt of the products, the customer must immediately inspect them for accuracy, completeness, and any damage. Any defects or damage must be reported to Fendo Fashion Group within 3 business days. Defects that could not be detected during a proper inspection and only become apparent later must be reported in writing immediately upon discovery. If you fail to inspect the goods or report the defect immediately, the goods will be considered approved, and you will forfeit all claims against us.

The statutory warranty regulations apply to manufacturing defects/material or production defects. The warranty period is two years from receipt of the product. Products damaged due to the buyer's own negligence are excluded from the warranty.

The customer's warranty claims are limited to replacement or repair/rectification of defects, excluding all other claims, in particular price reductions or compensation for indirect and consequential damages. Fendo Fashion Group decides at its own discretion whether to provide a replacement or rectify the defect. If the replacement or rectification fails, the customer is entitled to withdraw from the contract in the case of significant defects.

The defective product must be returned to the Fendo Fashion Group address above, along with a copy of the invoice and a detailed description of the defect. Return shipping is at the customer's expense and risk. Please obtain and retain proof of return, as your warranty claim cannot be processed if the package is lost.

10. Registering for an account

When you register a customer account, you can view information about your completed, open, and recently shipped orders, as well as manage and save your address details, payment information, and newsletter preferences. Because your data is saved, you won't need to re-enter it for future purchases.

When you register for such an account, you are responsible for ensuring that the personal information you provide for registration is truthful and complete. Fendo Fashion Group assures you that your data will be treated confidentially and will not be shared with unauthorized third parties. Registration is free. Each customer is only entitled to one customer account. We reserve the right to delete individual applications and to issue warnings, block, or delete registered customers who violate these Terms and Conditions or individual agreements, or to modify their account content.

Fendo Fashion Group is not obliged to accept the registration or order of a registered customer.

11. Complaints and complaints

We place great importance on customer satisfaction. You can reach us at any time using the contact details provided above. We strive to process your inquiries and complaints as quickly as possible and will contact you after receiving your documents, input, or complaint. For complaints or issues, please help us by providing us with the exact problem or error codes and, if possible, a copy of the order documents or at least the order number, customer number, etc. Our goal is to respond within 7 business days.

12. Data protection

Fendo Fashion Group collects and processes personal data only within the framework of legal regulations, in particular in compliance with applicable data protection laws. Further information on the processing of your personal data, your rights, and related questions can be found in our privacy policy at https://fendo.ch/datenschutzerklaerung, which forms an integral part of these terms and conditions.

13. Copyright

The information and content published on this website are protected by copyright and are the property of Fendo Fashion Group or the respective copyright holder. Reproduction, modification, distribution, or any other form of use requires the prior written consent of the respective rights holder. Fendo Fashion Group and the respective rights holder expressly reserve all rights in this regard.

14. Severability Clause

Should any provision of these Terms and Conditions be or become unlawful, invalid, or unenforceable for any reason, this shall not affect the validity of the remaining provisions. Unless otherwise agreed, the invalid provision shall be deemed replaced by a valid provision that most closely reflects the economic purpose of the original provision and the intentions of the parties at the time of contract formation. The same applies to any gaps in these Terms and Conditions.

15. Online Dispute Resolution

The European Commission has established an online platform for alternative dispute resolution for consumers residing in the EU, providing an out-of-court procedure for resolving all disputes relating to and arising from online sales contracts. 16. Applicable Law and Jurisdiction

These General Terms and Conditions, the contractual relationships based thereon and any disputes arising therefrom shall be governed exclusively by substantive Swiss law, excluding conflict of laws rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

The place of jurisdiction for natural persons is the registered office of Fendo Fashion Group. For legal entities, the registered office of Fendo Fashion Group is the exclusive place of jurisdiction.

These provisions apply only to the extent that mandatory provisions of the law of the state in which the consumer has his habitual residence do not take precedence over these terms and conditions.
