The following General Terms and Conditions (hereinafter “GTC”) apply to all business relationships between Fendo Fashion Group (hereinafter “Sample AG”, “we” or “us”) and the customer (hereinafter “Sample AG”, “customer”, “buyer” or “you”) for products (hereinafter “products” or “goods”) purchased through our website Fendo Fashion Group (hereinafter “online shop” or “website”).

Any individual agreements made with the customer take precedence over these General Terms and Conditions. Conditions of the customer that contradict or deviate from these terms are not accepted.
Fendo Fashion Group reserves the right to change these General Terms and Conditions at any time. Any changes will take effect with the publication of the new GTC on the website. When purchasing a product, the applicable General Terms and Conditions are those in effect on the date the binding order is placed.
Please read these General Terms and Conditions carefully before placing a binding order. By placing a binding order for our products, you agree to the following terms and our privacy policy, and declare that you are authorized to enter into legally binding contracts and are at least 18 years old.
The presentation of products in the online shop does not constitute a legally binding offer, but merely an informal online catalog or an informal invitation to the customer to order the product in the online shop. Fendo Fashion Group expressly reserves the right to change the products themselves, as well as the content, such as images, assortment, prices, and descriptions of our products, at any time and without prior notice. Images, pictures, brochures, advertisements, and other information about our products are for informational purposes only and are not binding for Fendo.ch.
The customer can place a binding order for the selected products via our online shop. The customer can place the selected products in the “shopping cart.” This does not yet constitute a binding order. An order is only considered binding when the customer clicks the “Place Order with Obligation to Pay” button at the end of the ordering process. Before submitting the order, the customer has the option to change and review the details at any time, recognize any input errors, and correct them before submitting the final binding order.
An order confirmation will be sent to the customer immediately and automatically via email. This confirmation email contains the details of your order and the General Terms and Conditions, which you accepted during the order process. The confirmation email serves solely to inform you that your order has been received by us. The automatic order confirmation does not yet constitute a purchase agreement. By submitting the order, you confirm that you have read the GTC and fully agree to them. We recommend printing or saving the GTC on your computer for your online order and documentation purposes.
After you have placed a binding order, Fendo Fashion Group is free to either accept or reject the order at its own discretion by sending an appropriate email notification, without assuming any liability to you or third parties. Any payment made will be refunded to you in the event of order cancellation. Reasons for rejecting an order may include, for example, if a product is no longer available, we are unable to obtain authorization for the customer’s payment, or there is reason to believe that the customer has violated these GTC, individual contracts, or engaged in fraudulent activities, or committed any other criminal actions or for other important reasons.
By accepting the order, a binding purchase agreement is concluded with the customer. This acceptance occurs through the dispatch of the ordered products.
Any commercial distribution or resale of our products is strictly prohibited.
All information regarding availability, shipping, and delivery of a product is preliminary and approximate. They do not constitute binding or guaranteed shipping or delivery dates. We expressly exclude liability for unavailable products or for delays in shipping or delivery.
Our products are available while supplies last. If Fendo Fashion Group determines during the processing of your order that the products you ordered are unavailable, we will inform you immediately.
We also reserve the right to limit the number of items a customer can purchase. In this case, we will inform the customer via email.

In case of payment delay, we reserve the right to charge reminder fees (starting at CHF 50) as well as statutory default interest.
Our products and prices correspond to those listed on the website. All prices are quoted in CHF (Swiss Franc), US Dollars, and Euro, and include the statutory VAT of 7.7%. The total price of your order, including all ancillary and shipping costs, will be displayed at the end of the ordering process. For shipments to countries outside Switzerland, additional customs fees may apply. These are not included in the price and must be paid by the customer.
By placing a binding order, you confirm that you agree with the total price for the ordered products. After the binding order, no price adjustments are possible.
Fendo Fashion Group reserves the right to change prices at any time. The calculation of products will be based on the prices offered at the time of the binding order.
Orders are generally due for immediate payment.
The customer has the option to pay with the payment methods displayed on the website or during the ordering process. These may change from time to time and may vary by country. Additionally, we reserve the right to not offer certain payment methods on a case-by-case basis and to refer to other payment methods used by us (e.g., to secure our credit risk, we may only offer those according to the respective credit rating). Fendo Fashion Group is expressly authorized by the customer to conduct credit checks at its discretion and, if necessary, to pass customer data to third parties for this purpose.
By choosing a payment method, the customer authorizes payment either by entering credit card details or payment service provider access details. The customer authorizes Fendo Fashion Group to accept or collect payments in an appropriate manner. In the event of chargebacks, Fendo Fashion Group is entitled to reimbursement of the associated costs and bank processing fees. Furthermore, Fendo Fashion Group is not liable for any fees or other amounts charged to you by the card issuer or your bank in connection with the processing of your payment according to your order.
If you pay by credit card or an alternative payment method, we reserve the right to check the validity of the card, verify the availability parameters for pickup, and verify address details, as well as request authorization from the card issuer or payment provider. You also confirm that the credit card is valid and the payment details entered are correct. In the case of payment refusal, Fendo Fashion Group reserves the right to cancel the order and halt the shipment of the products. In this case, we will contact you promptly.
For payment by invoice, the customer will receive the invoice with a payment slip either with the delivery of the goods or via email. Payment must be made using the payment slip within the payment deadline indicated on the invoice. If payment is not made on time, Fendo Fashion Group is entitled to charge reminder fees of at least CHF 50.– per reminder, as well as any additional collection-related costs and statutory default interest. If the initiation of a debt collection procedure is necessary, an additional processing fee of at least CHF 200 will be charged.
Deliveries are generally made via the Swiss Post AG delivery service. For deliveries within Switzerland, the costs must be paid in advance by the buyer. For deliveries to the EU, the following delivery services are used: Swiss Post AG or couriers such as DHL, TNT. The desired delivery service can be selected during the order process. The associated costs must be paid in advance by the buyer.
The products you order from our online shop that are in stock will be shipped to you within 8 working days after receipt of the full payment, depending on the destination. You can track the current location of your order using the tracking number.
If the products are marked as out of stock at the time of ordering, Fendo.ch will make every effort to deliver the products as quickly as possible. Fendo Fashion Group strives to meet the indicated delivery times. However, Fendo Fashion Group is not responsible for delivery delays, regardless of the reasons. We will inform you immediately about any delays in delivery.
If the performance obstacle lasts longer than 5 weeks after the original delivery date, the customer is entitled to withdraw from the order. Further claims, especially claims for damages, are excluded.
If the delivery of goods fails due to the customer’s fault despite two delivery attempts, Fendo Fashion Group may withdraw from the contract. Any payments made will be refunded immediately.
Fendo Fashion Group remains the owner of the delivered products until full payment has been made.
Customers can exchange unworn, undamaged, and unaltered items within 14 days of delivery. The return of discounted items is excluded. Purchased items can either be exchanged directly in the store or returned by post. Return shipping within Switzerland is possible. The customer is responsible for the cost of return shipping.
In the case of a return, customers can choose between an exchange or a voucher for the value of the returned item. If the customer chooses one of these two options, they must indicate this on the appropriate form and send the completed form to Fendo.

Fendo Fashion Group guarantees that the goods correspond to the promised characteristics and are free of defects that could impair their value or suitability for the intended use.
Upon receiving the products, the customer must immediately check for accuracy, completeness, and any damages. Errors or damages must be reported to Fendo Fashion Group within 3 working days. Defects that could not be discovered during proper inspection and that appear later must be reported immediately after discovery in writing. If the inspection or immediate reporting of the defect is omitted, the goods are deemed accepted, and no claims can be made against us.
The statutory warranty provisions apply in the case of manufacturing defects/material or production errors. The warranty period is 2 years from receipt of the product. Products that have been damaged due to the buyer’s own fault are excluded from the warranty.
The customer’s warranty claims are limited to replacement delivery or defect rectification/remediation, excluding all other claims, especially reduction or compensation for indirect damages and consequential damages. Fendo Fashion Group decides at its discretion whether to deliver a replacement or remedy the defect. If the replacement delivery or remediation fails, the customer is entitled to withdraw from the contract in the case of significant defects.

The defective product must be returned to the above-mentioned Fendo Fashion Group address with a copy of the invoice and a detailed description of the defect. The return of a product is at the customer’s expense and risk. Please have your return confirmed and keep this confirmation, as in the event of a package loss, your warranty claim cannot be processed.
When registering a customer account, you can view information about your completed, open, and recently shipped orders, as well as manage and store your address information, payment details, and any newsletters. Since your data is stored, you do not have to enter it again when making a future purchase.
When you register for such an account, you are responsible for ensuring that the personal information required for registration is truthful and complete. Fendo Fashion Group assures you that your data will be treated confidentially and not shared with unauthorized third parties. Registration is free. Each customer is only entitled to maintain one customer account. We reserve the right to delete individual applications and to warn, block, or delete registered customers who violate these terms and conditions or individual agreements, or to modify their content.
Fendo Fashion Group is not obligated to accept the registration or order of a registered customer.
We place great importance on customer satisfaction. You can contact us at any time using the contact details provided above. We strive to process your inquiries and complaints as quickly as possible and will contact you after receiving the documents or your inquiry/complaint. When filing complaints or claims, please assist us by providing the exact problem or error details and, if possible, a copy of the order documents or at least the order number, customer number, etc. Our goal is to respond to you within 7 working days.
Fendo Fashion Group collects and processes personal data only in accordance with the legal provisions, particularly in compliance with applicable data protection laws. The information and content published on the website are protected by copyright and are the property of Fendo Fashion Group or the respective copyright holder. Reproduction, editing, distribution, or any other form of utilization requires the prior written consent of the respective rights holder. Fendo Fashion Group and the respective rights holder expressly reserve all rights in this regard.
If any provision of these terms and conditions is or becomes unlawful, invalid, or unenforceable for any reason, it will not affect the validity of the remaining provisions. Unless otherwise agreed, the invalid provision will be replaced by a valid provision that closely reflects the economic purpose of the original provision and the parties’ intent at the time of the contract’s conclusion. The same applies to any gaps in these terms and conditions.
The European Commission has established an online platform for alternative dispute resolution for consumers residing in the EU, which provides an out-of-court procedure for resolving disputes related to online purchase contracts. These terms and conditions, the contracts based on them, and any disputes arising from them are exclusively governed by substantive Swiss law, excluding conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For individuals, the place of jurisdiction is the location of Fendo Fashion Group. For legal entities, the place of jurisdiction of Fendo Fashion Group is the exclusive jurisdiction.
These provisions apply only to the extent that mandatory provisions of the law of the country in which the consumer has their habitual residence do not take precedence over these terms and conditions.
